Terms and conditions of the contract
Given that:
a) IdeaProfumi di De Rosa Paolo, registered office in Battipaglia (SA) at via Rosario Livatino 7, VAT number IT06125600657, sells perfumery and cosmetic products remotely through its e-commerce site www.ideaprofumi.it.
b) These General Conditions apply to the purchase of products and services made remotely via the Internet on the website www.ideaprofumi.it.
c) All purchase transactions are governed by the Consumer Code (Legislative Decree No. 206/2005 and subsequent amendments, most recently updated by Legislative Decree No. 26 of March 7, 2023, implementing EU Directive 2019/2161), which governs consumer protection in distance contracts. With regard to privacy protection, EU Regulation 2016/679 (GDPR) and Legislative Decree No. 101/2018 apply.
d) The parties to this contract are IdeaProfumi di De Rosa Paolo, hereinafter the COMPANY, and the accepting purchaser, hereinafter the CUSTOMER.
Art. 1 – Acceptance of the conditions of sale
Upon confirmation of the purchase order transmitted electronically, the CUSTOMER unconditionally accepts and undertakes to observe the general and payment conditions set forth below, declaring that he has read and accepted all the information provided pursuant to the above-mentioned regulations, also acknowledging that the COMPANY is bound by the same regulations.
Art. 2 – Purchase methods
2.1) The website www.ideaprofumi.it offers cosmetic and perfumery products.
2.2) The purchase of the products, available as illustrated and described online in the relevant descriptive and technical sheets, is made by the CUSTOMER at the price indicated therein (VAT included), to be confirmed at the time of sending the order confirmation, in addition to shipping costs, if applicable, as displayed at the time of purchase.
2.3) Before confirming the purchase, the CUSTOMER will be shown a summary of the unit cost of each selected product, the total cost if purchasing multiple products, and any applicable shipping costs. In the event of promotions or price reductions, the lowest price applied in the previous 30 days will be indicated, pursuant to the Omnibus Directive (Legislative Decree 26/2023).
2.4) Upon acceptance of the purchase made by the CUSTOMER using the "Order with obligation to pay" button (or equivalent wording), the sale will be concluded, and the COMPANY will send the CUSTOMER an email containing the date and total amount of the order.
Art. 3 – Description of the products
The product descriptions on the website www.ideaprofumi.it are not binding and may be subject to change by the manufacturer. Images are indicative and not binding. Product names and brands are used for product identification purposes only. The COMPANY declines all liability for inaccuracies in product specifications or documentation.
Art. 4 – Obligations of the parties
4.1) The COMPANY undertakes:
a) To communicate to the CUSTOMER all the information required by articles 49 et seq. of the Consumer Code (Legislative Decree 206/2005 and subsequent amendments).
b) To send the goods requested by the CUSTOMER via courier to the address provided by the CUSTOMER, in the manner and within the timeframes set forth in Article 6 of this contract, free from defects that render them unsuitable for their intended use or significantly reduce their value.
4.2) The CUSTOMER undertakes:
a) To keep these general conditions of sale, already viewed and accepted during the purchasing process.
b) To provide advance payment for the order placed using the methods set out in Article 5 of this contract.
Art. 5 – Payments
Payment for the order and any shipping costs, if applicable, must be made by the CUSTOMER upon confirmation of the order using one of the following methods:
a) Credit/debit card
We accept all major credit/debit cards issued by banks: VISA, MASTERCARD, and AMERICAN EXPRESS. Card payments are quick, easy, and secure.
b) PayPal
The PayPal platform guarantees maximum security. The COMPANY never has access to the CUSTOMER's credit card information, as the transaction is handled 100% by PayPal's secure server.
c) Advance bank transfer
The CUSTOMER must send a copy of the receipt via email. The COMPANY will process the order upon actual receipt of the bank transfer.
d) Scalapay
If you purchase with Scalapay, you'll receive your order immediately and pay in three installments. The installments will be assigned to SCALAPAY SRL (Via Giuseppe Mazzini, 9 – 20123 Milan – VAT No. IT 06891080480), related parties, and their assignees, and the CUSTOMER authorizes this assignment.
Art. 6 – Delivery methods and times
6.1) Products purchased by the CUSTOMER will be delivered to the address indicated by the CUSTOMER. Deliveries will take place on weekdays, excluding Saturdays. Deliveries may be split if the product is out of stock, without this implying any liability on the part of the COMPANY. Before collection, the CUSTOMER is required to verify that the package is intact, undamaged, and unwet.
6.2) Orders will be processed within 48-72 hours of acceptance. Delivery will take place within 24-48 business hours, excluding holidays, remote areas, and smaller islands.
6.3) If the CUSTOMER is not present at the time of delivery, he or she can contact the COMPANY at the contact details indicated, which will notify the logistics company to make a new delivery attempt.
6.4) In the event that the CUSTOMER refuses delivery without justification, the latter will be required to pay €20.00 as reimbursement for the costs of returning the goods to the sender, in addition to any legal fees.
Art. 7 – Right of withdrawal
7.1) The CUSTOMER has the right to withdraw from the contract within 14 days of receiving the product, without having to provide a reason, pursuant to Articles 52 et seq. of the Consumer Code (Legislative Decree 206/2005 and subsequent amendments). If the COMPANY fails to provide the information regarding withdrawal, the withdrawal period is extended to 12 months.
7.2) The right of withdrawal is exercised by sending written notice to the COMPANY, via registered mail with return receipt or certified email (PEC), within the aforementioned deadline. Notice sent via regular email must be confirmed within 48 hours by registered mail with return receipt.
7.3) Following a correctly exercised withdrawal, the COMPANY will reimburse the CUSTOMER within 14 days of receiving the returned product, including the standard shipping costs originally incurred, net of the cost of collection by courier equal to €10.00 if organized by the COMPANY.
7.4) In the event that the CUSTOMER does not exercise this right in the manner and within the timeframe established, the contract is considered concluded and the COMPANY has the right to request payment of the price.
Art. 8 – Information and complaints
For any clarification or complaint, the CUSTOMER can contact the COMPANY through the "Contacts" section accessible from all pages of the website www.ideaprofumi.it.
For consumer disputes, it is possible to resort to alternative dispute resolution (ADR/ODR) procedures recognized pursuant to Legislative Decree 130/2015. The European ODR platform was discontinued on March 20, 2025 (EU Regulation 2024/3228).
Art. 9 – Jurisdiction and competent court
This contract is governed by Italian law. Any dispute concerning the validity, interpretation, or performance of this contract shall be subject to the exclusive jurisdiction of the Court of Salerno , without prejudice to the consumer's right to bring proceedings before the court of his or her place of residence pursuant to EU Regulation 1215/2012 (Brussels I bis).
Art. 10 – Returns and refunds

The refund will be processed no later than 14 days after receiving the returned product. The returned product must not have any damage caused by the CUSTOMER and must be in the same condition in which it was received, with the original packaging and wrapping intact.
The cost of collection by courier organized by the COMPANY is €10.00 , which will be deducted from the refunded amount.
